Terms and Conditions

Article 1

These terms and conditions apply to all agreements between the customer, hereinafter referred to as the buyer, placing an order via the webshop www.florissant.be, and Florissant [Wingepark 18, 3110 Rotselaar, Belgium], hereinafter referred to as the seller. These sales terms and conditions are an irrevocably integral part of the site’s ordering routines and as such are shown for approval prior to placing an order. The buyer has to agree to be bound by these terms and will need to accept them before completing his order.


Article 2

The buyer is responsible for providing all the correct and complete information required for delivery. The seller who, due to incorrect or incomplete information, cannot deliver on time or cannot  deliver at all shall not be held responsible.

Article 3

The order is confirmed once the payment is completed by the buyer. However, even after the payment is completed, the seller reserves the right to refuse any order. In this case the full amount will be refunded without any additional compensation.

Article 4

Because of the specific nature of the products [fresh, perishable, hand-tied and customized] orders cannot be modified or canceled after the confirmation of orders. As per the Belgian Market Practices and Consumer Protection Act of April 6th 2010, the right to revocation is inapplicable to the products on this website.

Article 5

Florissant bouquets are carefully arranged with freshly purchased flowers. In the event of unforeseen circumstances or supply difficulties, the seller reserves the right to subsitute a product of equal value and quality without notice.

Article 6

Delivery is considered completed in the following cases: (a) upon delivery at the address provided; or (b) upon delivery at a neighbouring address with notification via an official note at the recipient’s address.
Should (b) be impossible, a re-delivery will be scheduled at a later time. The delivery time slots are indicative. We accept no liabililty for any failure to deliver or any delay caused by any event or circumstance beyond our reasonable control [such as fire, strike, accident, breakdown of systems or network access, natural disaster, road blockage,…]. Late deliveries on account of these circumstances are no reason for compensation or refunds.

Article 7

All complaints regarding delivered goods must be filed within 48 hours after reception. Complaints regarding visible defects and/or non-compliant deliveries should be clearly documented with photos. Return of the delivered goods will take place only after explicit and written approval  by the seller. The liability of the seller remains in any case limited to a refund of the amount paid by the buyer.

Article 8

All disputes which cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the Belgian court in Leuven.

Article 9

The fact that the seller does not invoke one or more of the terms and conditions of sale against the buyer implies no renunciation of the right to do so and does not exclude any later reference to these conditions. These terms and conditions can be amended at all times.
